These documents set out the standard terms and conditions of providing property letting services to a landlord who is seeking to let a residential property. Our property letting pack includes two T&Cs documents: one for use when the agent is providing letting services only and where the agent is providing letting and full management services.
These documents set out the precise arrangements for the provision of services by a letting agent to a landlord wishing to let a residential property, taking into account the particular requirements of the property letting industry including: property mis-description, commission paid if tenant purchases the property - but only if as a direct result of the Agent's brokerage (in light of the decision in OFT v Foxtons), collection and handling of deposits, collection of rent, managing repairs and vetting prospective tenants.
An optional application form is also included so that you can provide the landlord with details of the application (including the services you will provide, the fees for various services, terms of payment etc) along with your standard terms and conditions.
All letting agents need to check that someone has the right to live in the UK before letting a property to them, if appointed by a landlord to do so. The appointment must be in writing and must be included in the list of services to be provided by the agent. Failure to carry out these 'right to rent' immigration checks can lead to civil and criminal penalties.
Once a tenant is found for the landlord's property a lease agreement between the tenant and the landlord will need to be drawn up, normally by the letting agent. We offer suitable tenancy agreements in our Property Letting section.
