A Section 33 Notice and a Notice to Quit must be sent by the landlord to the tenant to legally terminate a Short Assured Tenancy in Scotland at the expiry of the tenancy.
The required period of notice for serving a Section 33 Notice is 2 months.
It is recommended that both forms are sent at the same time by recorded delivery. The notices must be sent at least 2 months before the tenancy is due to end. If you don't meet that deadline, the tenant may be legally able to stay on in the house after the agreed date of termination.
