The Section 25 Notice is for use by a landlord with a commercial lease in England or Wales where:

  • security of tenure is guaranteed under the Landlord and Tenants Act and
  • the landlord is happy to offer the tenant a new lease at the end of the current term .

To end a current tenancy and propose terms for renewal landlord needs to send the tenant a Section 25 Notice with details of the proposed terms of the new tenancy. The landlord and tenant would then typically discuss and agree terms. If an agreement can't be reached then either party can apply to the court to grant a new tenancy and settle the terms.

A Section 25 Notice must be sent between 6 and 12 months before the landlord wants the current tenancy to end - which itself must be after the normal expiry date of the lease. It cannot be sent if the tenant has already sent a Section 26 Notice.
