SMP1 Form - Why I cannot pay you Statutory Maternity Pay

This SMP1 form, issued by the DWP (Department of Welfare and Pensions), is used to tell an employee why she does not qualify for Statutory Maternity Pay.

An employee may not be eligible to receive SMP if:

  • she has not been employed for long enough
  • her earnings are too low
  • she has not given adequate notice
  • she did not provide medical evidence soon enough
  • she did not inform employer that baby had been born soon enough
  • she was detained in custody on or after the first day of the SAP period
  • she returned to work for a different employer.
