Deed of Revocation
This Deed of Revocation is suitable for use
in Scotland and can be used to cancel:
- General Power
of Attorney, at any time after the Power has been granted
- a Continuing or Welfare Power of Attorney at any time (either before
or after registration) while the Granter still has mental capacity or in the
event they regain it.
It is necessary
to inform the Attorney(s) of the revocation as the Attorney's authority
does not cease until he or she receives notice of the revocation. A
copy of the Deed of Revocation should therefore be sent to each Attorney
and where the Continuing or Welfare Power of Attorney has been registered,
a copy of the Deed should be sent to the Office of the Public Guardian
also, stating that the Attorney(s) have been notified. A certificate completed by a Prescribed Person must be attached to the letter informing of the revocation.
