A Notice to Quit is a written document served by a landlord on a tenant or a tenant on a landlord and has the effect of bringing the contractual tenancy agreement to an end on its natural expiry. To legally terminate a Short Assured Tenancy in Scotland at the expiry of the tenancy, the landlord must send the tenant two forms: a Notice to Quit and a Section 33 Notice.
The required period of notice for serving a Notice to Quit depends on the length of the current tenancy period. If the tenancy is for more than 4 months, the notice period is a minimum of 40 days. If the tenancy is for 4 months or less, the notice period is one-third of the tenancy period, subject to a minimum of 28 days.
It is recommended that both forms are sent at the same time by recorded delivery. The notices must be sent at least 2 months before the tenancy is due to end (since the notice period for serving a Section 33 Notice is 2 months). If you don't meet that deadline, the tenant may be legally able to stay on in the house after the agreed date of termination.
