Student wins disability case

Law student, Riam Dean, has won her case for wrongful dismissal against retailer Abercrombie & Fitch. Miss Dean told her employer she had a prosthetic arm after being given a job in their Savile Row store. She claimed that she was then forced off the shop floor because her disability was contrary to the store’s ‘looks’ policy and was thereafter made to work in the stockroom. Abercrombie & Fitch operate very strictly enforced image rules for staff.

The tribunal ruled that she had been wrongfully dismissed and unlawfully harassed, but did not uphold her claim for disability discrimination. The US firm was ordered to pay Miss Dean more than £9,000 for injury to her feelings, loss of earnings and damages.
