A Ground 2 Notice will normally be required (by the Housing Act 1988) to be served if a property being let as a Short Assured Tenancy is subject to a mortgage. The mortgage lender will inevitably make it a condition of consenting to the let.
The document notifies the tenant that the property is subject to a mortgage and that the tenancy may be terminated before the end of its agreed term if, as a result of the landlord not making the mortgage payments, the mortgage lender now wants to sell the property to cover the landlord's debts.
The Ground 2 Notice is suitable for use in Scotland and should be served on the tenant before the creation of the tenancy.
