General Power of Attorney Form

A General Power of Attorney (POA) is created for a limited period when the Granter is unable to act for some reason and wishes someone else to have the authority to act on his or her behalf. We offer two versions (see below). For use in Scotland.

Usually, a General Power of Attorney form is created for a set period of time in cases where the Granter is going abroad or is unable to act for some other reason and wishes someone else to have the authority to act on his or her behalf. A General Power of Attorney will usually end either at a specified time or upon the request of the Granter at any time using a Deed of Revocation and will automatically be revoked if the Granter loses mental capacity.

This General Power of Attorney gives the Attorney authority to take decisions and actions on behalf of the Granter, as if the Granter were taking them himself or herself, in relation to nearly all the Granter's property and financial affairs. This could include buying or selling property or shares, signing cheques etc. It does not enable the Attorney to exercise functions which the Granter has as a trustee or executor of someone's estate.

There is no requirement for the General Power of Attorney to be registered.

We offer two types of General Power of Attorney: one that allows the appointed Attorneys to act on behalf of the Granter in nearly all the Granter's property and financial affairs and one that limits the powers to operating bank accounts (including signing cheques). Both versions allow the Granter to appoint up to four Attorneys.

General Power of Attorney: gives the Attorney authority to take decisions and actions on behalf of the Granter, as if the Granter were taking them himself or herself, in relation to nearly all the Granter's property and financial affairs. This could include buying or selling property or shares, signing cheques etc. It does not enable the Attorney to exercise functions which the Granter has as a trustee or personal representative (i.e. where the Granter is the co-owner of land or the administrator of someone's estate). The package includes the General Power of Attorney and a Deed of Revocation, all for use in Scotland.

Power of Attorney (Banks/Cheques): If the Granter does not wish to give the Attorney a general power he or she can limit the Attorney's activities to specific areas of the Granter's property and financial affairs, such as operating bank/building society accounts or signing cheques. The document package includes: a Power of Attorney to Operate Bank Accounts, one to sign cheques and a Deed of Revocation, all for use in Scotland.
