An AT5 form must be served on a prospective tenant by the landlord before the tenancy begins. The AT5 informs the tenant that the tenancy is a Short Assured Tenancy in terms of Section 32 of the Housing (Scotland) Act 1988. The form must be served by giving it to the tenant personally or sent by recorded delivery to the tenant's last known address. It is recommended that the landlord serves the form in duplicate and gets one copy back signed by the tenant in acknowledgement of receipt .

The tenancy itself should be covered by use of a Tenancy Agreement.

If at the end of one Short Assured Tenancy the landlord offers the same tenant another Short Assured Tenancy of the same property, he need not serve another Form AT5 and the tenancy may be for less than 6 months
