Adoption Leave Procedure

This adoption procedure sets out the rights of eligible employees to take paid leave to allow employees who are adopting a child to take time off when a child is placed with them for adoption. The policy sets out the minimum amounts of statutory adoption pay and leave to which employees are entitled when a child is placed for adoption within the UK or is adopted from overseas. To qualify, the employee must have been continuously employed by the company for at least 26 weeks.

The adoption leave policy is suitable for use in England, Wales and Scotland for employees who are due to have a child placed with them for adoption, or who have a child adopted from overseas entering the UK, on or after 5 October 2008 and covers:

  • period of adoption leave
  • rates of statutory adoption leave pay
  • periods of notice
  • rights of employee during adoption leave
  • rights of employee on return to work.

As well as the adoption leave policy this package of documents also includes:

Adoption declaration A declaration by an employee electing to receive statutory adoption pay and not statutory paternity pay. This declaration should be given to the employee to sign and date and return to the employer.
Adoption letter A letter from the employer to the employee outlining the employee's eligibility for adoption leave and pay. This letter must be sent within 28 days of the employee's notification of the date they wish to start adoption leave.

SAP1 A statutory form used to tell an employee why they do not qualify for statutory adoption pay.
SAP2 A statutory form used by the employer to record details of an employee's statutory adoption pay.
